Welcome to Aruba Water Experience. By booking or participating in any of our activities, you agree to the following Terms & Conditions.

1. General
   Aruba Water Experience provides water-based tours, rentals, and activities. By making a reservation, you confirm that you have read, understood, and agreed to these Terms & Conditions.

2. Booking & Payment
   • All bookings must be made through our website or authorized channels.
   • Full payment is required to confirm your reservation unless otherwise stated.
   • Prices are listed in [USD/AWG] and are subject to change without prior notice.

3. Cancellation Policy
   • Cancellations made at least 24 hours in advance are eligible for a full refund.
   • Cancellations made within 24 hours of the scheduled activity are non-refundable.
   • No-shows will be charged the full amount and are not eligible for a refund.
   • In case of cancellations by Aruba Water Experience due to weather or operational reasons, guests may reschedule or receive a full refund.

4. Participation Requirements
   • Participants must follow all instructions given by guides and staff.
   • Certain activities may have age, weight, or health restrictions.
   • Guests must be in good physical condition and disclose any medical conditions that may affect participation.
   • Aruba Water Experience reserves the right to refuse service to anyone deemed unfit or unsafe to participate.

5. Safety & Liability Waiver
   • Participation in water activities involves inherent risks, including but not limited to injury, drowning, or equipment failure.
   • By participating, you acknowledge and accept these risks.
   • Aruba Water Experience, its owners, employees, and affiliates shall not be held liable for any injury, loss, or damage sustained during activities, except where required by law.

6. Equipment Use
   • All equipment must be used responsibly and according to instructions.
   • Guests are responsible for any loss or damage to equipment caused by misuse or negligence.
   • Safety gear provided (e.g., life jackets) must be worn when instructed.

7. Weather Conditions
   • Activities are subject to weather and sea conditions.
   • Aruba Water Experience reserves the right to cancel or modify activities for safety reasons.

8. Arrival & Check-In
   • Guests are required to arrive at least 15–30 minutes prior to the scheduled activity time.
   • Late arrivals may result in reduced activity time or cancellation without refund.

9. Alcohol & Drugs
   • Participation under the influence of alcohol or drugs is strictly prohibited.
   • Aruba Water Experience reserves the right to refuse service without refund if a guest appears impaired.

10. Photography & Media
    • Aruba Water Experience may take photos or videos during activities for promotional purposes.
    • By participating, you consent to the use of such media unless you notify us otherwise in writing.

11. Personal Belongings
    • Guests are responsible for their personal belongings.
    • Aruba Water Experience is not liable for lost, stolen, or damaged items.

12. Privacy
    • Any personal information collected during booking will be used solely for reservation and operational purposes and handled in accordance with applicable privacy laws.

13. Changes to Terms
    Aruba Water Experience reserves the right to update or modify these Terms & Conditions at any time without prior notice.

14. Governing Law
    These Terms & Conditions are governed by the laws of Aruba. Any disputes shall be resolved within the jurisdiction of Aruba.
